Important Notice
These Terms & Conditions ("Terms") govern your access to and use of the Ovyacare website and the Ovyacare mobile application, which provide menstrual cycle tracking, period and fertility predictions, symptom and wellness logging, personal health-record management, and optional connections to hospitals and healthcare providers (collectively, the "Services"). By using our Services, you agree to comply with these Terms and all applicable laws in India, including the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000. If you are under 18, your parent or legal guardian must accept these Terms on your behalf.
1. Acceptance of Terms
By accessing or using the Ovyacare Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Services. If you are under 18 years of age, these Terms must be accepted on your behalf by your parent or legal guardian, who agrees to be bound by these Terms and to be responsible for your use of the Services, and who confirms they have provided the consent required under applicable law, including the Digital Personal Data Protection Act, 2023.
2. Eligibility and User Accounts
The Services are intended for individuals who wish to track their menstrual cycle and related health information: adult women, and adolescent girls who have reached menarche. If you are under 18, you may use the Services only where a parent or lawful guardian has reviewed and accepted these Terms on your behalf and provided verifiable consent to the processing of your personal data as described in our Privacy Policy; the parent or guardian is responsible for the account and for supervising your use of the Services. You must provide accurate and complete registration details and maintain the confidentiality of your login credentials, and you (or your guardian) must notify us immediately of any unauthorized use of your account.
3. Use of Services
You agree to use the Services only for lawful purposes consistent with applicable Indian laws. You agree not to misuse or interfere with the Services, attempt unauthorized access to any part of the system, or use another person's account without permission.
4. Medical Information and Advice
The Services provide tools for logging and understanding your cycle and health data, but they do not provide medical advice, diagnosis, or treatment. Cycle, ovulation, and fertile-window predictions are statistical estimates based on the data you log; they may be inaccurate, particularly for adolescents and users with irregular cycles. Predictions must not be used as a method of contraception or as the sole basis for attempting or avoiding pregnancy. The Services do not diagnose, screen for, or treat any medical condition, including PCOS, endometriosis, or thyroid disorders. Always consult a qualified healthcare professional for medical concerns, and seek immediate medical attention in an emergency. Ovyacare disclaims liability for health decisions made solely on the basis of predictions or data from the platform, to the extent permitted by law.
5. User Data and Confidentiality
Ovyacare processes personal data — including sensitive menstrual and reproductive health data — in accordance with the Digital Personal Data Protection Act, 2023 and our Privacy Policy. Access to this data within Ovyacare is restricted on a need-to-know basis and protected by appropriate security controls. Data of users under 18 is handled with the additional safeguards described in our Privacy Policy. You retain ownership of the data you log; we process it only as described in the Privacy Policy.
6. Intellectual Property Rights
All intellectual property rights related to the Services, including software, design, text, and graphics, belong to Ovyacare or its licensors. Users may not reproduce, distribute, modify, or create derivative works without explicit permission. This section does not affect your rights over your own personal data.
7. Data Security and Privacy
Ovyacare implements reasonable administrative, technical, and physical safeguards — including encryption in transit and at rest — to protect user data from unauthorized access, loss, or misuse, as required under applicable law. While no system can be guaranteed completely secure, nothing in these Terms limits our statutory obligations to protect your data or your statutory rights if we fail to do so.
8. Third-Party Services
We engage service providers (such as cloud hosting, analytics, crash reporting, and notification services) that process data under our instructions and contractual safeguards; we remain responsible for their processing of your personal data as required by the DPDP Act. Separately, independent third parties you choose to interact with through the Services — such as hospitals or clinics you book with, or people you share reports with — are responsible for their own handling of your information; please review their terms and privacy policies.
9. Limitation of Liability
Nothing in these Terms excludes or limits Ovyacare's liability under the Digital Personal Data Protection Act, 2023, the Consumer Protection Act, 2019, or any other liability that cannot be excluded under applicable law, including liability arising from a failure to implement reasonable security safeguards. Subject to the foregoing, and to the maximum extent permitted by law, Ovyacare is not liable for indirect or consequential losses arising from the use or inability to use the Services.
10. Termination and Suspension
Ovyacare may suspend or terminate accounts or access to the Services for violations of these Terms or for operational reasons, with prior notice where practicable. You (or, for users under 18, your parent or guardian) may stop using the Services and delete the account at any time from within the app or as described in our Privacy Policy.
11. Modifications to Terms
We may modify these Terms. We will notify you of material changes by email and in-app notice at least 15 days before they take effect, and — where a change requires it — seek fresh consent, including the verifiable consent of a parent or guardian for users under 18. Continued use after the effective date of a change means acceptance of the updated Terms.
12. Governing Law and Jurisdiction
These Terms shall be governed by Indian law. Subject to any rights you have under applicable consumer-protection law, disputes shall be subject to the jurisdiction of the courts located in Coimbatore, Tamil Nadu.
